Faster Than Advertised Speeds

Alright got a question, when people get faster speeds than advertised does that have to do with the company not strictly enforcing it or what, cause a tweak on the computer side shouldnt increase the speed faster than adverstied if they are the ones controlling it, right :?:

Many companies "overprovision" meaning if your advertised speed is 3000/256 your caps may actually be 3360/290 or something.  This is usually to compensate for some loss of speed that may occur with networks.  If there is little congestion or for some other reason the network isn't limited as much, it is possible to obtain speeds above advertised.
