im supposed to be 'uncapped' and do about 7mbs down and 500-700k up (constant) but im capped and do 700kb down / 45 up

alright well i upgraded to tier 3 on cable recently and..i seem to still be capped, i called cox and all and they dont know whats up with the speed...constant speeds arnt even that good can get 45 up constant...but it stops at 45...and from what i hear, tier 3 for cox is basically uncapped...anyone?
